ANKARA - The Musa Anter Case, which will drop due to prescription on September 20, has been postponed to September 21.
The final hearing of the case, which was consolidated with the JİTEM Main Case regarding the murder of Kurdish scholar and journalist Musa Anter on September 20, 1992 in Diyarbakır, and the case of Ayten Öztürk, who was killed by Mahmut Yıldırım, code named “Yeşil” in 1993, was held at the Ankara 6th High Criminal Court.
Peoples' Democratic Party (HDP) MPs Fatma Kurtulan, Kemal Peköz, Abdullah Koç and Republican People's Party (CHP) MP Yıldırım Kaya as well as Public Workers' Union Confederation (KESK) Co-chairperson Mehmet Bozgeyik, Co-Chair of the Human Rights Association (İHD) Öztürk Türkdoğan and representatives of non-governmental organisations was in court to observe the hearing, in which Musa Anter's son Dicle Anter was also present.
WARRANT NOT PROCESSED
In the hearing, which started with the reading of the documents added to the file after the identification, it was stated that a report was taken about the accused Hamit Yıldırım by the Şırnak Code of Criminal Procedure (CMK) Execution Office on the ground that he did not fulfill his judicial control obligation, and that the arrest warrants of the defendants were not responded to.
The lawyer of the accused Hamit Yıldırım, who took the floor at the hearing, claimed that his client did not fulfill his legal control obligations due to his health problems.
ANTER: THERE IS NOTHING TO SAY
Dicle Anter said: "There is nothing left to say under these conditions. The case will drop due to prescription on September 20. This is a crime against humanity. We will continue our struggle in the international arena.”
TÜRKDOĞAN: PRESCRIPTION IS CRIME AGAINST HUMANITY
Stating that the fact that the case will drop due to the prescription was a great concern for his client and the prescription of the case is a crime against humanity, Attorney Öztürk Türkdoğan said: "While I was looking at the parliamentary investigation reports, I saw the unsolved political murders investigation report of 1995. The Anter murder is also mentioned in this report. The aim is to spread fear in the Kurdish people. In this report, a criminal complaint was also filed against the State Security Court (DGM) Chief Prosecutor. The necessity of these reports could not be fulfilled, but this lawsuit was filed with our efforts.After the truth is revealed, the court will evaluate, but I think closing the case before it is revealed will create new violations. There are so many incidents like the murder of Musa Anter, the murder of Mehmet Sancar and Uğur Mumcu. In 1993, a research commission report was formed to investigate the events in Kurdistan. Again, the requirements are not met. In 1997, the Susurluk report was prepared. Under the influence of these reports, Mehmet Ağar was tried and convicted as the leader of a criminal organisation. How many years have passed, we are still seeking justice, but the perpetrators still do not receive the punishment they deserve. We demand that these reports should be read by the court. We demand that the deficiencies in the file be completed and that Abdulkadir Ayhan's statement to be taken. We demand an arrest warrant for Hamit Yıldırım and this trial should continue.”
"WE HAVE AN ILLEGAL ORGANISATION BEFORE US"
Attending the hearing and stating that they saw that the murder in question had the aim of causing public outrage, Serhat Menzilcioğlu, attorney of Orhan Miroğlu said: “Mehmet Eymür confessed to the crimes he witnessed in his deposition. We have an illegal organisation before us. Murders are committed for the reasons specified in Article 77. It took actions to arouse fear in the society. We want Abdülkadir Aygan's statement to be awaited for the prescription."
DEFENDANT'S LAWYERS
Hikmet İşler, the lawyer of retired colonel defendant Savaş Gevrekçi said that the case should be dismissed and claimed that his client is "innocent".
The lawyer of the accused Hamit Yıldırım described the murder as a "media event". Yıldırım's lawyer said that Abdülkadir Aygan's statement should be taken and that the case should be dropped.
'THE REPORT SHOULD BE DOUBT'
Dicle Anter requested the original documents sent from Sweden to the Ministry of Justice. Anter stated that Hamit Yıldırım received a late notification regarding the violation of judicial control and said, “They could not submit a report within 6 days.This causes suspicion."
HEARING POSTPONED TO ONE DAY AFTER IT DROPS DUE TO PRESCRIPTION
The court adjourned the hearing to one day after September 20 (September 21), when the case will drop due to prescription. The court stated that the defense's claim that the case constitutes a crime against humanity and that it is not subject to the prescription in this respect, and requests for discrimination against the file will be considered in the next session.
