Relatives of the disappeared and the Human Rights Association (İHD) Diyarbakır Branch came together once again in the 714th week of the "The disappeared people should be found, The perpetrators should be prosecuted". Relatives of the disappeared, who came in front of the Right to Life Monument in Koşuyolu Park in Diyarbakır, carried photographs of their deceased relatives. This week, the relatives of the disappeared told the story of Fehmi Tosun, who was lost in custody on October 19, 1995, and demanded that the perpetrators be found.

 

34 UD 597 PLATE VEHICLE

 

Fehmi Tosun, two friends who left home together on the morning of October 19, 1995, never returned. Fehmi Tosun was brought in front of his house in a white Renault vehicle with 34 UD 597 plate, by three people in civilian clothes, armed, with radio, and was taken back to the vehicle by force. Neighborhood residents also witnessed the event. The police, who checked the plate and made phone calls, said there was nothing they could do. The Family Human Rights Association took all legal measures and brought the incident to the relevant units of the government and the public agenda. However, it was not accepted that Fehmi Tosun was taken into custody and he was never heard from again. The case was moved to the European Court of Human Rights when no results could be obtained from the domestic law. However, the AKP government, which accepted the responsibility of the state for the violation of Fehmi Tosun's right to life at the ECtHR, did not fulfill its obligation to ensure an effective investigation in the Fehmi Tosun case. The file, which was decided not to drop due to prescription, was closed.

 

AN EFFECTIVE INVESTIGATION SHOULD BE MADE'

 

The family said: "It has been 27 years since Fehmi Tosun's disappearance in custody and that there has been no effective investigation regarding Fehmi Tosun, the obligation to carry out an effective investigation regarding Fehmi Tosun immediately be fulfilled, those responsible for the crime should be identified and punished. No matter how many years pass; For Fehmi Tosun, we will not stop wanting justice for all our losses and reminding that the state has to act within universal legal norms.”
