MARDİN - A non prosecution decision was given by the court about the criminal complaint filed by F.A, who was taken into custody during the trustee protests and was sexually abused and threatened with rape by the police under custody. Attorney Fevzi Adsız stated that the prosecution did not listen the witnesses and did not watch the camera recordings before expressing his opinion.

F.A, a citizen was taken into custody during the protests following the appointment of a trustee to the Mardin Metropolitan Municipality on August 19, 2019 and the cuts on her body inflicted by the police needed 6 stitches. F.A who was insulted by the police because she did not sign the documents the police gave her, was later sexually assaulted with a police baton at the Provincial Security Directorate and was threatened with rape. F.A filed a criminal complaint later when she was released.

The Prosecutor's Office issued a "Decision Not To Prosecute (KYOK)" on the criminal complaint. The prosecutor's office, which alleged that no signs of assault were found in the examination of F.A. and stated that the cuts that needed 6 stitches were caused by her resistance to the police who used force gradually in accordance with her resistance. The prosecutor's office who found the fact that F.A did not tell about the incident she filed a criminal complaint for in her testimony, was contrary to logic, said there was not enough evidence to file a public case.

In addition, it was noteworthy that no research was conducted on the demand made to listen to journalists and citizens who witnessed the incident and to examine the security camera records.

Stating that they expected the witnesses and the journalists to be heard  and asked for security camera records to be examined, F.A's attorney Adsız announced that they would appeal against the decision of KYOK.
