İSTANBUL - Saim Adıgüzel, brother of Hakan Adıgüzel, who is imprisoned in Sincan High Security Prison, stated that his brother, who had health problems due to prison conditions, was not treated.
51 people were detained within the scope of the investigation carried out by the Istanbul Chief Public Prosecutor's Office regarding the throwing of a Molotov at a coffeehouse in 1999 and the death of a person in the district of Samandıra, located in the Sancaktepe district of Istanbul. Hakan Adıgüzel, member of the Youth Branch of the People's Democracy Party (HADEP), which was closed within the scope of the file, and his older brother Saim Adıgüzel, were also detained in front of their house in Gültepe Mahallesi in Şişli.
While 49 of the names taken to the Istanbul Security Directorate were released, the Adıgüzel brothers, who were detained for 8 days, were taken to a forest by the police for 3 days with their eyes closed and tortured. Later, his older brother Adıgüzel was released from the police station. Hakan Adıgüzel, on the other hand, was arrested and sent to Ümraniye Prison, on charges of "destroying the unity and integrity of the state" as a result of the trial held at the State Security Court (DGM). The sentence of Adıgüzel, who was given the death penalty as a result of the trial, was turned into "aggravated life imprisonment" with the abolition of the death penalty on July 14, 2004. Adıgüzel, who was transferred to prisons in Ümraniye, Tekirdağ, Kırklareli, Erizirom and Edirne, is currently being held in Sincan No. 2 Type T High Security Prison.
He talked about the arrest process of his brother Saim Adıgüzel and his brother, the diseases he was caught due to prison conditions and the rights violations he was exposed to.
POLICE CREATED PERPETRATOR
Pointing to the time he was detained with his brother, Adıgüzel said: "The police took them from the detention center where they stayed at midnight, took them to the forest area and tortured them for hours. When we were tortured in the woods, when I asked, 'What do you want from us,' the police replied, 'The state wants perpetrators from us. We found you. We will leave one of you, whichever one of you is responsible for'. At the end of the 8th day, they dropped me off from the police station. Hakan was arrested by being referred to the court, and the trial process has begun.”
ATTACK ON LAWYERS
Stating that he was constantly exposed to psychological violence when he visited his brother, Adıgüzel said: "The trial process took 13 years. The offices of the lawyers dealing with my brother's case were scanned. Two lawyers in the office were shot in the legs with guns. Despite this, the lawyers did not abandon the case. One of the lawyers committed suicide at home in the 6th year of the trial."
13 YEARS PRISON SENTENCE
Pointing out that his brother was detained for 13 years and this situation is against the Constitution, Adıgüzel said: "If a person cannot be imprisoned for 13 years, that person is 'not guilty'. The constitution says so; however, they gave this punishment. The SSCs of the period were illegitimate courts. We could not get any results against our objections.”
THE PRISONER IS NOT TREATED
Mentioning the violations in the prison, Adıgüzel said: "My brother was not taken to the air conditioning. My brother's cell was constantly searched by the guards and the items they sent to him were constantly sent back, my brother was afflicted with various diseases due to prison conditions. My brother had lumbar hernia, Parkinson's and eye diseases but was not treated, and our applications to the Ministry of Justice were repeatedly inconclusive. We applied to the Forensic Medicine Institute (ATK), the Constitutional Court (AYM), and the Presidential Communication Center (CIMER), but we did not get a positive result."
